Excerpts from the BSTA DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS


Article 5: SECTION 1.  Creation of the Lien and Personal Obligation of Assessments.  The Declarant, for each Lot it owns within the Properties, hereby covenants, and each Owner of any Lot by acceptance of a deed therefore, whether or not it shall be so expressed in such deed or other conveyance, is deemed to covenant and agrees to pay to the Association:  (1) the hereafter provided applicable annual assessments or charges, and (2) special assessments for capital improvements, such assessments to be fixed, established and collected by the Brinkley Station Townhouse Association, Inc. as hereinafter provided.  The annual and special assessments, together with interest thereon, costs of collection thereof, and reasonable attorney’s fees, shall be a charge on the land and shall be a continuing lien upon the property against which each such assessment is made.  Each such assessment, together with such interest, costs and reasonable attorney’s fees, shall also be the personal obligation of the person who was the Owner of such property at the time when the assessment fell due.  The personal obligation for delinquent assessments shall not pass to his successors in title unless expressly assumed by them.


Article 5: SECTION 8.  Effect of Nonpayment of Assessments:  Remedies of the Association.  Any assessments which are not paid when due shall be delinquent.  If the assessment is not paid within thirty (30) days after the due date, the assessment shall bear interest from the due date at a rate determined by the Board of Directors; not to exceed the maximum legal rate of interest. A late charge in the amount of $15.00 or one-tenth of the total amount of any delinquent assessment or installment, whichever is greater, may be levied if any assessment is not paid within fifteen (15) days after it is due.  Said late charge may only be levied once for each delinquent payment.  The Association may bring an action at law against the owner personally obligated to pay the same, or foreclose the lien against the Property.  Interest, costs and reasonable attorney’s fees for any such action shall be added to the amount of such delinquent assessments.  No Owner may waive or otherwise escape liability for the assessments provided for herein by non-use of the Common Areas or abandonment of his Lot.

It is everyone's obligation to pay their HOA assessments and ensure the well-being of our community. 

Your annual HOA assessment pays the necessary operating expenses that keep our community association running.  Such as maintenance and upkeep of the common areas (snow removal and landscaping) Capital improvements (signs, fencing, parking lot enhancement, mailbox cluster maintenance etc), repairs, reserves, and management of the BSTA Community.       

The BSTA Board of Directors has the obligation to ensure that consistent collection policies are implemented. 

Why should I pay my HOA Assessments?
1.  To protect the investment of your property.
2.  Maintain and/or increase property value.
3.  Ensure services such as snow removal, and landscaping.
4.  Maintain and make improvements to the community. 
5.  Have a voice in the community—vote for matters that impact the community.
6.  Maintain parking privileges.

7.  Ensure the financial well-being of the Brinkley Station Townhouse Community.

8.  Ensure that BSTA continues to be a desirable place to live.

It is the responsibility of each homeowner to contribute to the well-being of your community by paying annual assessments. 
 
PLEASE PAY YOUR ASSESSMENTS on time.  Please be aware that late and non-payments may result in suspension of parking privileges.


Accounts that are not paid when due shall be delinquent.  Delinquent accounts not paid within 30 days after the due date may have parking privileges suspended without notice.  Any vehicle found parked in a suspended space or using a suspended/voided visitor’s pass will be towed at the owner’s expense until the account is current or an acceptable payment plan has been established.
